Designed by Stefan Antoni Olmesdahl Truen Architects, this contemporary, sea-facing apartment is not only unusual in design but has great views of the sea and the mountains behind Camps Bay, especially from its cobalt blue rim-flow pool that literally perches on the edge of the property. The sophisticated living room is oval in shape and these curves are reflected throughout the apartment, giving it a fluidity seldom found in compact spaces. The easy flow of lines - from the oval dining table used to link the entry area with the luxuriously comfortable interior of the living room, through to the curved kitchen counters – give it an airy and spacious atmosphere. Neutral colourways are accented with mahogany and the entire scheme is calming and serene. The front two en-suite bedrooms have expansive sea views and the third faces the garden and the ever-changing vistas of Lion’s Head and the mountains behind Camps Bay. 1.The Tenant hereby agrees to the occupation of the premises for use as short-term accommodation for the period as set out in the attached booking form and agrees to pay the rental for the full period (prior to occupation), free of any deduction or set-off.
2.Cancellations more than 30 days prior to arrival will be subject to a 50% cancellation fee. Cancellations less than 30 days prior to arrival will be subject to a 100% cancellation fee. The Tenant is responsible for travel and cancellation insurance.
3.An inventory will be supplied at the date of occupation. The Tenant will have 24 hours to check, sign and return the inventory schedule noting any defective or missing items, failing which the inventory shall be deemed to have been handed over in good order and condition. The Tenant undertakes to keep the contents and equipment in the same condition as at the commencement of occupation and confirms that that the cost of any missing / broken / damaged items will be deducted from the security and breakages deposit.
4.The cost of telephone services provided during the period of occupancy is for the Tenant’s account. Should the Tenant not settle the final accounts for telephone services supplied during the period of occupation prior to departure, the total amounts due will be deducted from the security and breakages deposit.
5.It is recorded that the entire Premises, including any carpets and upholstery, will be clean and in good order on the date of occupation. The Tenant undertakes, on termination, to deliver the Premises in the same good order. Should Seeff, upon inspection, find that the Premises is not clean and in the same good order as at the date of occupation, they will engage the services of professional cleaners and/or carpet cleaners, at the cost of the Tenant and deduct such cost from the refundable security and breakages deposit.
6.A damage deposit equal to 20% (a minimum of R 1,000.00, maximum R 10,000.00) of your booking will be reserved against a valid credit card prior to arrival. Should there be no breakages or damages, this deposit will be released. Should any damages or breakages be found, the monetary value will be charged on your credit card.
7.The premises are let for the sole use as a private residence only. The number of tenants is not to exceed the number set out on the attached confirmation.
8.Seeff will not be held responsible for any inconvenience caused by any building work in the vicinity of the property.
9.Seeff accepts no liability whatsoever in respect of any theft, loss, damage or injury to the Tenant whether due to any negligence on the part of the Landlord, their agents, their staff or otherwise.
10.The Tenant undertakes to maintain reasonable noise levels at the property at all times as excessive noise may be in contravention of the body corporate rules and/or the municipal by-laws. In the event of the Tenant transgressing the body corporate rules and/or the municipal by-laws, he/she accepts that this may lead to the short term lease being cancelled by the Landlord or Seeff, and in which case all monies paid will be forfeited.
11.The cost of replacement of all keys, tags and remotes not returned to Seeff will be deducted from the refundable security and breakages deposit. This could include the replacement of all security keys to re-secure a complex.
12.The Tenant hereby chooses domicilium citandi et executandi for all purposes at the premises. The Tenant accepts that this Agreement shall be governed and construed in accordance with the laws of the Republic of South Africa, and in case of dispute, the Tenant irrevocably agrees to submit to the jurisdiction of the High Court of South Africa or the Magistrates Court of South Africa, at the election of Seeff Properties. In the event of the Landlord and/or Seeff taking any action against me, I agree to pay costs on the attorney and own client scale.
13.In the event of the premises not being available, Seeff shall endeavor to find suitable alternative accommodation but will not in any circumstances be held responsible for any losses suffered by the Tenant as a result thereof. In the event of cancellation by the Landlord all monies held by Seeff on behalf of the tenant will be refunded.
14.In the event of the Tenant vacating the premises prior to the contracted departure date for any reason whatsoever, he/she shall have no claim for the refund of any rental monies from Seeff and/or the Landlord.
15.In the event of the Tenant breaching any term of this agreement, Seeff shall be entitled to terminate this agreement forthwith and the Tenant undertakes to immediately vacate the premises. Any breach by the Tenant shall constitute a material breach for the purposes of any proceedings taken against the Tenant.
16.The Tenant agrees that Seeff and/or their agents or representatives shall be entitled to inspect the premises upon reasonable notice at all times during the rental period.
